Shipyard Negligence Incident: Doyle Dennis Avery LLP Vs. Keppel Amfels

Doyle Dennis Avery LLP has been hired to file suit under the general maritime law of the United States in Cameron County District Court, Brownsville, Texas.

Doyle Dennis Avery LLP’s attorneys filed suit against a negligent shipyard owner, Keppel Amfels, for injuries suffered by its client during repairs of a vessel in the Ingleside/Corpus Christi area.  On or about September 26, 2020, Keppel Amfels, by and through its supervisors, employees, and agents, failed to provide a reasonably safe work environment on the vessel Janet Marie.  More specifically, Keppel Amfels placed a make-shift piece of wood that obstructed the use of a ladder used by Doyle Dennis’s client and his supervisor.  As a result, the firm’s client suffered a serious fall from height (approximately 15 feet) and injuries to his head, wrist, and lumbar spine (including a burst fracture, that has resulted in one surgery to date).  Those injuries have continued with disabling pain and numbness, often requiring the use of a cane or walker.  In all, Keppel Amfels use of the makeshift piece of wood was negligent under maritime law in the way that it was placed on the vessel, and Keppel Amfels refused to address the issue before the plaintiff’s incident, in spite of previous complaints by co-workers.  Only after the incident in question did Keppel Amfels acknowledge responsibility for the unsafe condition by removing the safety obstacle.

Based upon this failure to follow maritime industry standards, the suit seeks damages to address the serious injuries suffered by Doyle Dennis Avery LLP’s client.  The types of damages available under maritime law and admiralty law included lost wages, lost future earnings, pain and suffering, mental anguish, medical bills, and physical impairment.
