Doyle Dennis Avery LLP recently filed a lawsuit against Defendant Viajes y Yates LLC, also known as Yate.co, in the United States District Court for the District of New Mexico on behalf of a client injured during Defendant’s boat tour in Cartagena, Colombia. On August 9, 2023, Doyle Dennis Avery LLP’s client was a passenger aboard a vessel owned and operated by Defendant. The client booked a day tour to the Rosario Islands while on vacation with her family in Cartagena, Colombia. Although the vessel used for the boat tour had a 10-passenger capacity, there were well above 10 passengers aboard with the client that day. Because Defendant’s vessel was at full capacity and there were no passenger seats available, the client was forced to sit on a bench at the highest point of the bow. On the return trip of the tour, Defendant’s Captain increased the speed of the vessel and began traveling twice as fast as other boats in the surrounding waters. After following dangerously close behind another boat, the Captain drove into its wake, causing the client to be violently thrown out of her seat and suffer serious injuries to her back, hips, and legs. As a result of this incident, the client was hospitalized for over a week in Colombia before she was flown to another hospital in Florida.
